TERMS OF SALE

  1. SELLER AND SCOPE

These Terms of Sale govern purchases made from KawaiiStitchClub, operated by the sole proprietor identified in the Legal Notice available in the store footer.

By placing an order, you confirm that you have read and accepted these Terms of Sale, our Terms of Service, Refund Policy, and Privacy Policy.

  1. DIGITAL PRODUCTS

KawaiiStitchClub sells downloadable digital cross stitch patterns. No physical product will be shipped.

The product page specifies the content, format, dimensions, skill level, and other relevant characteristics of each pattern. Colors may appear differently depending on the customer’s screen, printer, software, fabric, and thread choices.

The customer is responsible for verifying that the stated file format is compatible with their device and software before purchasing.

  1. AVAILABLE MARKET

The store currently accepts orders through the United States market only.

If checkout is unavailable in a customer’s location, KawaiiStitchClub does not accept orders from that location. Activating additional markets in the future will not affect orders placed under the present version of these Terms.

  1. PRICES AND TAXES

Prices are displayed in US dollars (USD).

The applicable price is the price displayed when the order is submitted. Any applicable taxes are calculated and displayed at checkout before payment is confirmed.

Prices and promotions may change without notice, but changes will not affect orders that have already been accepted.

  1. ORDER PROCESS

The customer selects a product, reviews the order, provides the required billing and payment information, and confirms the purchase through Shopify Checkout.

Placing an order constitutes an offer to purchase. An order is accepted after payment has been authorized and an order confirmation has been issued.

KawaiiStitchClub may refuse or cancel an order in cases including payment failure, suspected fraud, technical error, incorrect pricing, unauthorized use, or violation of these Terms. If payment has already been collected for a cancelled order, the corresponding amount will be refunded.

The customer is responsible for providing accurate and current information, particularly a valid email address.

  1. PAYMENT

Payment is processed securely through the payment methods displayed at checkout.

The customer confirms that they are authorized to use the selected payment method. KawaiiStitchClub does not directly collect or store complete payment card details.

The order must be paid in full before the digital files are made available.

  1. DIGITAL DELIVERY

After payment is confirmed, the purchased files are made available through Shopify’s digital delivery service and may also be sent by email.

Delivery may occasionally be delayed by payment review, email filtering, platform availability, or another technical issue.

If a download link is missing, inaccessible, expired, or the file is corrupted, the customer should contact kawaiistitchclub@hotmail.com. KawaiiStitchClub will restore access or provide a working copy within a reasonable time.

  1. LICENCE OF USE

Purchasing a digital pattern grants the customer a limited, non-exclusive, non-transferable licence for personal use only, unless the relevant product page expressly states otherwise.

The customer may download and print the file for personal use.

The customer may not:

  • resell, redistribute, share, sublicense, exchange, or give away the digital file;

  • upload the file to a website, social network, file-sharing service, group, marketplace, or artificial intelligence system;

  • reproduce or modify the pattern for resale;

  • claim the pattern or its design as their own;

  • use the pattern, previews, charts, instructions, or other included content for commercial purposes without prior written permission.

The purchase does not transfer any intellectual property rights to the customer.

  1. CANCELLATIONS AND REFUNDS

Because the products are digital and access is generally provided immediately after payment, orders cannot normally be cancelled or refunded after the download has been made available.

This restriction does not affect any mandatory rights that cannot legally be excluded.

A replacement, correction, or refund may be provided when:

  • the file is corrupted or cannot be opened in the stated format;

  • the customer does not receive access to the purchased file;

  • the delivered product is materially different from its description;

  • the same product was accidentally purchased more than once;

  • the purchase was unauthorized and sufficient supporting information is provided.

Change of mind, failure to read the product description, lack of compatible software, or dissatisfaction caused solely by personal preferences does not normally qualify for a refund.

  1. CONFORMITY AND TECHNICAL SUPPORT

KawaiiStitchClub is responsible for providing a digital product that corresponds to its description and functions in the file format stated on the product page.

If a product contains a confirmed error, KawaiiStitchClub may provide a corrected file, restore access, replace the product, reduce the price, or issue a refund, depending on the nature of the problem and any mandatory law that applies.

The customer must describe the problem and, where useful, provide screenshots or other information reasonably necessary to identify it.

Nothing in these Terms excludes a mandatory legal guarantee or consumer right that applies to the order.

  1. CUSTOMER RESPONSIBILITIES

The customer is responsible for:

  • providing accurate order and contact information;

  • downloading and securely storing purchased files;

  • using compatible software and equipment;

  • respecting the licence and intellectual property restrictions;

  • keeping download links and files private;

  • checking the product specifications before ordering.

KawaiiStitchClub is not responsible for problems caused solely by incompatible software, unsupported devices, incorrect printing settings, loss of files after successful delivery, or alterations made by the customer.

  1. INTELLECTUAL PROPERTY

All patterns, charts, instructions, illustrations, photographs, previews, text, branding, and downloadable content remain the intellectual property of KawaiiStitchClub or their respective rights holders.

Unauthorized reproduction, distribution, resale, or commercial exploitation may result in the suspension of access and appropriate legal action.

  1. LIABILITY

To the extent permitted by law, KawaiiStitchClub is not liable for indirect, incidental, or consequential losses arising from the use or inability to use a digital product.

KawaiiStitchClub’s total liability relating to an order will not exceed the amount paid for the product concerned, except where such a limitation is prohibited by applicable law.

Nothing in these Terms limits liability for fraud, wilful misconduct, gross negligence, or any liability that cannot legally be excluded.

  1. FORCE MAJEURE

KawaiiStitchClub will not be responsible for a delay or failure caused by an event beyond its reasonable control, including a major platform outage, payment network failure, cyberattack, natural disaster, government action, or widespread internet disruption.

This provision does not remove the customer’s mandatory rights if the digital product is ultimately not supplied.

  1. COMPLAINTS

Customers should first submit any complaint to:

The customer should include the order number, the email address used for the order, a description of the problem, and any relevant supporting information.

KawaiiStitchClub will attempt to respond and resolve the complaint within a reasonable time.

  1. GOVERNING LAW AND DISPUTES

These Terms of Sale are governed by French law.

This choice of law does not deprive a customer of any mandatory consumer protection granted by the laws that apply to them.

If an amicable resolution cannot be reached, any dispute will be submitted to the courts having jurisdiction under applicable law.

  1. CHANGES TO THESE TERMS

KawaiiStitchClub may update these Terms of Sale when necessary. The version applicable to an order is the version published when that order is placed.
